Also, make sure to record the names of any emergency personnel such as police officers or paramedics who respond to the scene. In addition, pay close attention to the behavior of those involved.

  • Do others appear to be injured?
  • What type of damage have the vehicles sustained?
  • Are there any unusual facts or circumstances surrounding the accident?
  • What is the weather like? Were the roads wet or dry? 
  • Were traffic signals working properly?
  • Was traffic heavy or light?
  • Have any witnesses made statements admitting they were negligent?

You should try to report these observations and potential evidence to the reporting police officer as soon as you are able. In general, while it may be difficult to stay focused in such a stressful situation, writing down your observations of the accident scene may help you prevail in any lawsuit that results from the accident later on. Once you are able, or as soon thereafter as possible, you should contact a competent personal injury attorney to discuss your case and the facts and circumstances surrounding the accident, before you make any statements to insurance company investigators, agents, or lawyers.
